These terms and conditions are binding and must be read before using or accessing our services or website. Upon visiting our site, placing a request quote or any of our services, you are obliged by these terms and conditions to a contract. You are not supposed to use our site or services if you do not agree.
Acceptance of Terms
These terms and conditions apply to the use of the SmartConstruct website and services which include the construction estimating services, shop drawing services and CAD drafting services. The fact that you have further accessed or used our platform is your acceptance of these terms and our privacy policy.
Scope of Services
SmartConstruct offers professional construction support services and they include but are not limited to construction cost estimate, shop drawing and CAD drafting solutions. All services will be advisory, informational and will be offered to help the clients throughout the planning, bidding and design processes.
We do not act as contractors, subcontractors or suppliers and we have no control over the price of materials, labor costs or contractor decisions.
User Responsibilities
The clients agree to provide adequate, accurate and timely project information which entails drawings, specifications, quantities and deadlines. SmartConstruct will not be responsible for errors, delays, mistakes and omissions caused by half-baked, erroneous or misleading information provided by the client.
Clients should always make sure that they have inspected the requirements at the site, the local rules and the cost of the contractors before they make decisions regarding the projects.
Services Requests and Approval
SmartConstruct has the right to review and accept all service requests. We also have the right to refuse any request that is beyond our competence, capabilities or internal procedures. Only after the scope approval and confirmation of payment, timelines and deliverables of projects will be finalized.
Pricing, Payments and Billing
Everything will be priced according to project scope, complexities and delivery schedules. Work must not commence unless full or advance payment is made, except where otherwise agreed in writing. No services will be initiated before the payment is made.
Payment methods may include secure online invoicing and approved digital payment platforms. The client is liable for any other processing fees involved.
Refund, Cancellation and Dispute Policy
After work has already started and one can no longer refund the payment. In case of cancellation of a project before work commences, we may give back a partial refund at our own will. The requests for cancellations should be in writing. Any disagreements on prices, scope and deliverables should be reported within 24 hours of the service delivery. Unannounced chargebacks can lead to the suspension of service at the moment.
Delivery Timelines and Revisions
Estimated delivery timelines are shared at the time of order confirmation. They may vary based on project complexity and client responsiveness. SmartConstruct has reasonable revisions at no cost but such revisions would apply only when the mistakes can be directly attributed to our team.
The extra charges may occur in the revisions or changes that will be made as requested based on the change of scope, new drawings or other needs.
Estimates Accuracy and Cost Disclaimer
All estimates will be done through the standard industry methodology and with available market data. Estimates are a guideline and do not reflect the final or a sure project cost. The actual costs can be changed because of labor rates, availability of materials, location, market changes or the contractor’s pricing policy.
Our deliverables are not substutues of contractor bids, supplier quotes, legal contracts or professional financial advice.
Limitation of Liability
We will not be liable to any direct, indirect, incidental, or consequential damages due to the use of our website, services or even deliverables. Our experts do not cause financial losses, delays in bidding, project delay and cost overruns.
We will only be liable to the extent of the price paid in respect of the individual service.
Intellectual Property Rights
We retain all the content such as estimates, drawings, CAD files, reports, text, graphics, logos and materials on the website as intellectual property, unless otherwise indicated. Clients have been given a non-transferable but limited right to use deliverables in their own approved projects only.
The unlicensed copying and selling, distributing or sharing of our content is strictly forbidden and can be legally punished.
Confidentiality and Data Handling
We consider any information and project documentation of our clients as a secret and only utilize it to provide the services. Our privacy policy regulates the practices of data handling. We are not selling or abusing client information. Non-disclosure agreement can be negotiated on demand.
Communications and SMS Terms
By submitting your contact information, you will agree to get service-related messages through email, telephone or SMS. Only explicit consent is sent through marketing messages. The message and data rates can be subject to use depending on your carrier. Communications may be stopped at any point by using the unsubscribe or STOP instructions.
Third-Party Tools and External Links
Our services can include third-party software or can have outside websites. We do not do performance, content or privacy of third-party platforms.
Suspension and Termination
We may suspend or cancel services without before notice in the event a client breaches these terms and conditions, misuses, gives false information or defaults on the resolution of payments. Dismissal does not abrogate arrears of payment.
Governing Law and Jurisdiction
These terms and conditions shall be applied and interpreted by reference to the existing laws. Any conflict, which may be based on these terms, should be placed under the exclusive jurisdiction of the relevant courts.
Modifications to Terms
SmartConstruct has the right to change or alter these terms and conditions at any time. We will update this page and the fact that you will be using our website or our services will be acceptance of the revised terms.
Severability and Entire Agreement
In case these terms are declared invalid or inadmissible, the rest of the terms shall not be invalidated. These terms form the whole agreement between SmartConstruct and the client in terms of the usage of services.
